Dirks Wash Pass monthly membership offered by Dirk's Car Wash (“Operator”) provides a package of washes (and free use of vacuums where available) on a monthly basis in each month that the pass is renewed. The monthly wash pass automatically renews until Customer cancels the service via the app. The operator reserves the right to cancel, amend, or change the program as it feels necessary. Membership can be canceled at any time by Customer. No refunds or credits will be given for partial periods. The operator reserves the right to close the wash at times due to adverse weather conditions or due to maintenance with or without notice. The monthly wash pass price is per vehicle washed at our facilities.

The customer understands that washing another vehicle with your monthly wash pass barcode will result in that vehicle being added to your monthly wash pass membership plan automatically and agrees to the associated increase in monthly charges.

By enrolling in the monthly wash pass program, Customer agrees that the credit/debit card provided can be charged automatically via auto-renewal. Customer also agrees that the Customer waives any and all right to withhold or delay payment of the related charges, whether as described in the Customer's agreement with the card issuer or otherwise.

Customer agrees that the Customer enrollment with their email address and cell phone number is the Customer's explicit consent to receive communication email and text messaging from the company regarding the wash pass account and car wash operations and updates including marketing activity. The Customer can unsubscribe from these messages at any time through standard cancel/unsubscribe practices and the Customer understands that if they cancel/unsubscribe, they will lose access to automated alerts regarding their Customer account. The Customer should consult the service agreement with their wireless carrier or contact their wireless carrier to determine their phone's pricing plan and the charges for sending and receiving text messages. The Customer acknowledges that they are responsible for any message, data, or other charges incurred (usage, subscription, etc.) as a result of using the message service.

The monthly wash pass cannot be used in conjunction with any other discounts or promotions.

By subscribing to the monthly wash pass service, I hereby grant the car wash operator, and its supplier, Dirk's Car Wash, non-revocable permission to capture my image and likeness in photographs, videotapes, motion pictures, recordings, or any other media (collectively “Images”). I acknowledge that Dirk's Car Wash will own such Images and further grant the Dirk's Car Wash permission to copyright, display, publish, distribute, use, modify, print and reprint such Images in any manner whatsoever related to its business, including without limitation, publications, advertisements, brochures, website images, or other electronic displays and transmissions thereof. I further waive any right to inspect or approve the use of the Images by Dirk's Car Wash prior to its use. I forever release and hold Dirk's Car Wash harmless from any and all liability arising out of the use of the Images in any manner or media whatsoever, and waive any and all claims and causes of action relating to use of the Images, including without limitation, claims for invasion of privacy rights or publicity.

Dirk's Car Wash respects your privacy and is committed to protecting your Personal Information. This Privacy Policy describes the types of Personal Information we collect and our practices for using, maintaining, sharing, and protecting it. It also describes the rights and choices you may have with respect to your Personal Information and how you may contact us about our privacy practices. This Privacy Notice applies to the following websites and any associated Operator websites, products, services, and mobile applications.

When using our site, you may choose to interact with features from third parties that operate independently from Company, such as social media widgets and links to third-party websites. Operator has no control over and is not responsible for the privacy practices of such third parties. This Privacy Notice does not apply to the extent the Operator does not own or control any linked websites or features you visit or use. We recommend that you familiarize yourself with the privacy practices of these third parties.

“Personal Information” means any information relating to an identified or identifiable individual. Examples of Personal Information Company may collect include:

• Payment information (credit card and other payment card information)
• Personal contact information (name, nickname, gender, mailing address, email address, phone number)
• Business information (office location, business contact information, department, job title/description, professional bio)
• Log-in credentials (username, password)
• Usage details (log-on activity, search terms, views, clicks, downloads, Company-related preferences, lead submission information)
• Technical details (IP address, geolocation information, cookie/session IDs, authentication information, browser type/version, operating system/platform)
• Any other information you or other Customers may upload or enter into the Services

This site collects and maintains personal information provided by its users, which includes names, addresses, mobile telephone numbers, email addresses, and so forth. The information submitted is used to provide assistance for inquiries regarding our processes and locations. The information is completely voluntary and is not shared with any third party vendors, marketers, affiliates, or service providers.

We will use necessary measures to protect the security of user data. However, the policy should also emphasize that it's impossible for the company to completely guarantee that user data will be immune from malicious attack or compromise; as such, the users should understand that their transmission of personal data is always at their own risk.

Signing Up and Opting-In to Receive Marketing Messages

Enrollment in the Service requires you to provide your mobile phone number and to agree to these terms and conditions (the “Terms”). Please only provide your own mobile phone number. You may not enroll if you are under 18 years old. Before the Service will start, you will need to verify the mobile phone number you provided by responding to a text message to your mobile phone that affirms your choice to opt-in to this Service and your agreement to these Terms. Note that by affirming this message, you are providing your consent to receive mobile text alerts with discounts and promotions from Dirk's Car Wash and acknowledging that these marketing messages may be delivered by automated technology. We will not sell or share your information with third parties or affiliates for marketing purposes. The phone number and consent will only be used to communicate with you. You may opt-in to receive sms messages from Dirk's Car Wash verbally, during conversation with sales associate, signing up to receive the carwash app via QR Code. Messaging frequency may vary. Message and Data Rates May Apply

Please consult your service agreement with your wireless carrier or contact your wireless carrier to determine your phone's pricing plan and the charges for sending and receiving text messages. You acknowledge that you are responsible for any message, data, or other charges incurred (usage, subscription, etc.) as a result of using the Service. The Service may not be available on all wireless carriers. Dirk's Car Wash add or remove any wireless carrier from the Service at any time without notice. Customers may opt-out of the Service at any time (see details below). Dirk's Car Wash is not responsible for any undue delays or errors in messages.

To Stop the Service

To stop receiving text messages from Dirk's Car Wash at any time, you can opt-out of the Service via text message. To stop receiving text messages from Dirk's Car Wash text STOP in a reply text message to any of the text messages you have received from Dirk's Car Wash. In response, you will receive a one-time opt-out confirmation text message. After that, you will receive no more marketing text messages from Dirk's Car Wash.

We can answer any questions about the Service. Dirk's Car Wash reserves the right to discontinue the Service at any time without notice.

The Operator may retain third party service providers to assist us in our business. For example, we may use service providers to assist with analytics, email marketing, payment processing, customer relationship management, and IT infrastructure and support. The Operator may permit these affiliates and service providers to access your Personal Information in order to assist us in providing services; however, we require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.

The Operator generally retains records only as long as necessary and as required for our business operations, for archival purposes, and/or to satisfy legal requirements. When determining the appropriate retention period for Personal Information, we take into account various criteria, such as the amount, nature and sensitivity of the Personal Information; potential risk of harm from unauthorized use or disclosure; purposes for which we process your Personal Information; whether we can achieve those purposes through other means; and business operations and legal requirements. Because we maintain our applications and websites to protect them from accidental or malicious loss and destruction, residual copies of your Personal Information may be retained in our backup and archival systems for a limited period of time, after which the information will be automatically deleted or put beyond use where deletion is not possible.
